Did you try the scp without sshpass (being prepared to type the password manually)? I suspect sshpass and ssh are fine and your issue is with scp/sftp only.
The main problem with your scp command is that you are passing the -D option, which tells it connect directly to a local program and not use ssh at all. That is not what you want. It would not have worked in bullseye either.
The path /usr/lib/sftp-server has not changed in bookworm. What has changed is that scp now defaults to attempting sftp at all, and your older embedded system may not support that. You possibly just need scp -O to revert to legacy behavior.
It would have been better to post the original error message, rather than risk misinterpreting it yourself.
